This Privacy Policy explains how Noontide Ventures LLC, a Georgia limited liability company and operator of Call Me Virgil ("Call Me Virgil," "Virgil," "we," "us," or "our"), collects, uses, stores, discloses, and protects information when you use CallMeVirgil.com and related services (the "Service").

Call Me Virgil is an AI-powered Socratic writing tutor for adult creative writers. If you have questions about this Privacy Policy, contact us at support@callmevirgil.com.

By using the Service, you acknowledge that you have read and understood this Privacy Policy.


1. Eligibility and Age Requirement

The Service is intended for users who are at least 18 years of age. By using the Service, you represent and warrant that you are at least 18 years old.

We do not knowingly collect personal information from anyone under 18. If we learn that we have collected personal information from a person under 18, we will take reasonable steps to delete that information. If you believe a person under 18 has provided us personal information, contact us at support@callmevirgil.com.

If we expand the Service to users under 18 in the future, including through schools or educational partnerships, we will provide a separate notice and applicable consent mechanisms at that time.


2. Information We Collect

We collect information you provide directly to us and information generated through your use of the Service.

2.1 Information You Provide

We may collect:

  1. Account information, such as your email address and authentication-related information.
  2. Writing you submit, including poems, scenes, essays, paragraphs, notes, drafts, fragments, revisions, and other text.
  3. Conversation content, including intake answers, messages you send to Virgil, feedback generated by Virgil, project names, conversation titles, and related writing context.
  4. Subscription and billing metadata, such as subscription status, plan type, Stripe customer ID, subscription ID, payment status, renewal status, and cancellation status.
  5. Support communications, including emails or other messages you send to us.

2.2 Information Collected Automatically

We may collect limited technical and usage information, such as IP address, browser type, device type, operating system, referring pages, pages or features accessed, request timestamps, error logs, performance and reliability data, and security and abuse-prevention signals.

We do not currently use third-party advertising trackers.

2.3 Sensitive Information

Call Me Virgil is designed for creative writing feedback, not for storing sensitive personal information. Please do not submit:

  1. Government identification numbers.
  2. Financial account numbers, credit card numbers, or payment credentials.
  3. Health, medical, or mental health information.
  4. Precise personal addresses or geolocation data.
  5. Sensitive information about yourself or others.
  6. Confidential information you do not have the right to share.

If you choose to include sensitive information in your writing or conversations, you do so at your own risk and consent to its processing as part of the Service. You are solely responsible for what you submit. We have no obligation to monitor user submissions for sensitive content, and we make no special protections for such content beyond those described in this Privacy Policy.


3. How We Use Information

We use information to:

  1. Provide, operate, maintain, and improve the Service.
  2. Authenticate users and manage accounts.
  3. Save writing, project, and conversation history.
  4. Generate AI-powered Socratic feedback.
  5. Maintain context across projects and conversations.
  6. Process subscriptions and manage billing access.
  7. Provide customer support.
  8. Send service-related emails, such as password reset links, billing notices, or account notices.
  9. Monitor reliability, debug errors, and improve performance.
  10. Conduct internal product evaluation, quality assurance, and testing, including reviewing conversations and outputs to improve the quality and safety of the Service.
  11. Generate aggregated or de-identified data and analytics for product development and business purposes.
  12. Prevent abuse, fraud, unauthorized access, and misuse.
  13. Enforce our Terms of Service.
  14. Comply with legal obligations and respond to lawful requests.

Use of writing for AI training. We do not sell your submitted writing, and we do not use your submitted writing to train foundation AI models that we make available to third parties or to the public. We may, however, use your writing and conversation content to operate, evaluate, debug, secure, and improve the Service, including through internal review of conversations and outputs and through aggregated or de-identified analysis. If we ever change this practice in a way that materially expands how your writing may be used to train AI models, we will update this Privacy Policy and provide appropriate notice.

In limited cases, authorized personnel or service providers may review submitted writing, conversation content, or outputs for support, debugging, safety, abuse prevention, quality assurance, or product improvement purposes.


4. Legal Bases for Processing (EEA / UK Users)

If you are located in the European Economic Area, the United Kingdom, or another jurisdiction with similar data protection laws, we process your personal information on the following legal bases:

  1. Performance of a contract: to provide the Service you request, manage your account, and process payments.
  2. Legitimate interests: to operate, secure, debug, and improve the Service; to prevent fraud and abuse; and to conduct internal evaluation and quality assurance, where these interests are not overridden by your rights.
  3. Consent: where we ask for it, such as for any optional features that require it. You may withdraw consent at any time without affecting prior processing.
  4. Legal obligation: to comply with applicable law, legal process, or regulatory requirements.

5. AI Processing

Call Me Virgil relies on third-party AI services, including Anthropic's Claude API, to generate Virgil's responses.

When you submit writing, intake answers, messages, or other content to Virgil, we send relevant portions of that content to our AI service providers so the underlying models can process it and return a response. This may include your submitted writing, prior conversation context, project context, and related messages needed to provide useful feedback.

Our AI service providers process this information under their own terms, policies, and privacy practices. You are responsible for reviewing those policies directly. We do not control, and make no representations about, how our AI service providers process, retain, or use data submitted through their services.

Because Call Me Virgil uses AI systems:

  1. Virgil's responses may be incomplete, inaccurate, biased, unhelpful, or inappropriate.
  2. Virgil is not a licensed professional and does not provide legal, medical, mental health, financial, educational, or other professional advice. Do not rely on Virgil for any such advice.
  3. If you are experiencing a mental health crisis or emergency, contact qualified professionals or emergency services. Virgil is not a crisis resource.
  4. You should not submit confidential, highly sensitive, or legally protected material unless you are comfortable with it being processed by our service providers.
  5. We do not guarantee that AI-generated feedback will be correct, original, publication-worthy, or suitable for any particular purpose.

6. Your Writing and Intellectual Property

You retain ownership of the writing you submit to Call Me Virgil. We do not claim ownership of your poems, essays, scenes, drafts, notes, or other creative work.

By submitting writing or other content to the Service, you grant Noontide Ventures LLC a limited, non-exclusive, worldwide, royalty-free, sublicensable license to host, store, process, transmit, display, modify solely for technical purposes such as formatting, and otherwise use that content solely as reasonably necessary to:

  1. Provide the Service to you.
  2. Generate Virgil's responses.
  3. Save and display your writing and conversation history.
  4. Maintain project and conversation context.
  5. Operate, debug, secure, evaluate, and improve the reliability and quality of the Service.
  6. Engage service providers, such as our AI, hosting, database, payment, and infrastructure providers, to perform the foregoing on our behalf.
  7. Comply with legal obligations.

This license does not give us the right to publish, sell, or commercially exploit your creative writing as our own work, and it terminates when you delete the relevant content or your account, except to the extent we are required or permitted to retain it under Section 11 (Data Retention) or applicable law.

Sublicenses to service providers are limited to the scope of this license and continue only as long as reasonably necessary for those providers to perform services for us, subject to applicable law, backup retention, security, and the data retention practices described in this Privacy Policy.

You are solely responsible for ensuring that you have all rights necessary to submit any writing or content you provide. You represent and warrant that your submissions do not infringe or violate the intellectual property, privacy, publicity, or other rights of any third party. Do not submit work that belongs to someone else unless you have the right to do so.


7. Service Providers

We use third-party service providers to operate the Service. These currently include:

  1. Supabase, for authentication, database storage, and backend services.
  2. Anthropic, for AI processing through the Claude API.
  3. Stripe, for payment processing, subscription billing, and customer portal functionality.
  4. Vercel, for hosting, deployment, serverless functions, logs, and infrastructure.
  5. Resend or similar providers, for transactional and support-related email.

These service providers process information on our behalf as needed to provide their services. Their processing is governed by their own terms and privacy policies. We are not responsible for third-party services except to the extent required by applicable law. We may change service providers from time to time without notice.


8. Payments

Payments are processed by Stripe.

Call Me Virgil does not store your full credit card number, card security code, or complete payment credentials. Stripe collects and processes payment information, billing information, transaction details, and related data according to Stripe's own terms and privacy policy.

We may store limited billing-related metadata, such as Stripe customer ID, Stripe subscription ID, subscription status, plan type, price ID, renewal period, payment status, and cancellation status, in order to determine whether you have access to paid features and to manage subscription-related support.


9. How We Share Information

We do not sell your writing or personal information, and we do not share personal information for cross-context behavioral advertising as those terms are commonly used under U.S. state privacy laws.

We may disclose information:

  1. To service providers that help us operate the Service, under appropriate confidentiality and data protection commitments.
  2. To process payments and manage subscriptions.
  3. To provide AI processing and generate responses.
  4. To comply with applicable law, legal process, subpoenas, court orders, or government or regulatory requests.
  5. To protect the rights, property, safety, or security of Call Me Virgil, our users, service providers, or others, including to enforce our Terms of Service or this Privacy Policy.
  6. To investigate fraud, abuse, security incidents, or violations of our Terms of Service.
  7. In connection with a business transaction, such as a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, insolvency, or transfer of all or part of our business or assets. In any such transaction, information may be transferred as a business asset, subject to a privacy policy at least as protective as this one for information already collected.
  8. With your consent or at your direction.

10. International Data Transfers

Call Me Virgil is operated from the United States. If you access the Service from outside the United States, your information will be transferred to, stored in, and processed in the United States and in other countries where we or our service providers operate. These countries may have data protection laws that differ from, and may be less protective than, those in your jurisdiction.

Where required by applicable law, including the GDPR or UK GDPR, we will rely on appropriate transfer mechanisms, such as the European Commission's Standard Contractual Clauses or equivalent UK transfer tools, or another lawful transfer mechanism made available by our service providers.

By using the Service, you acknowledge and consent to the transfer and processing of your information in the United States and other jurisdictions, to the extent permitted by applicable law.


11. Data Retention

We retain account information, writing, project history, conversation history, and subscription metadata for as long as your account is active or as needed to provide the Service.

If you delete your account, we will use commercially reasonable efforts to delete or de-identify your account data from our active production systems within ninety (90) days, except for information we are required or permitted to retain under this Section 11 or applicable law.

We may retain information for additional periods as needed to:

  1. Comply with legal, regulatory, tax, accounting, or recordkeeping obligations.
  2. Resolve disputes and enforce agreements.
  3. Maintain security and prevent fraud or abuse.
  4. Maintain backups, archives, and disaster-recovery systems, in which residual copies may persist for up to twelve (12) months before being deleted in the ordinary course of business.
  5. Maintain billing, transaction, and audit records as required by law.

Deletion of your account from our systems may not delete information already processed by, or retained by, third-party service providers, except to the extent required by applicable law or supported by those providers.


12. Security

We use reasonable technical and organizational measures designed to protect information against unauthorized access, loss, misuse, and alteration.

However, no internet service, database, hosting provider, payment system, or AI system can be guaranteed to be completely secure, and we do not warrant or guarantee the security of any information transmitted to or stored on the Service. You use the Service at your own risk.

You are responsible for maintaining the confidentiality of your login credentials and for any activity under your account. Notify us promptly at support@callmevirgil.com if you believe your account has been compromised.

In the event of a data breach affecting your personal information, we will notify you and applicable regulators as required by applicable law.


13. Privacy Rights and Choices

Depending on where you live, you may have certain rights regarding your personal information, which may include the right to:

  1. Request access to personal information we hold about you.
  2. Request correction of inaccurate information.
  3. Request deletion of your information.
  4. Object to or restrict certain processing.
  5. Request a portable copy of certain information.
  6. Withdraw consent where processing is based on consent.
  7. Lodge a complaint with a supervisory authority, for users in the EEA or UK.

To make a request, contact support@callmevirgil.com. We may need to verify your identity before responding, and we may decline or limit requests where permitted by applicable law, including where retaining information is necessary for security, legal compliance, billing, fraud prevention, defense of legal claims, or other legitimate business purposes.

We will respond to verifiable requests within the timeframes required by applicable law.

You may also stop using the Service at any time, cancel your subscription through the billing portal, request account deletion, or contact us with privacy questions.


14. U.S. State Privacy Notices

We do not sell personal information and we do not share personal information for cross-context behavioral advertising as those terms are defined under U.S. state privacy laws, including the California Consumer Privacy Act, as amended.

Where applicable U.S. state privacy law grants you specific rights based on your state of residence, which may include rights of access, correction, deletion, portability, opt-out, or non-discrimination, you may exercise those rights by contacting support@callmevirgil.com. We will respond as required by applicable law.


15. Email Communications

We may send you service-related emails, such as account verification or authentication messages, password reset emails, subscription or billing notices, important service updates, and support responses. These messages are necessary to operate the Service and are not promotional.

We do not currently send marketing emails. If we begin sending marketing emails, we will provide an appropriate way to opt out as required by applicable law.


16. Third-Party Links and Services

The Service may contain links to, or integrations with, third-party websites, applications, or services. This Privacy Policy does not apply to those third-party websites, applications, or services, and we are not responsible for their content, practices, or privacy policies. You should review the privacy policies of any third-party services you use.


17. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will update the "Last updated" date above and may provide additional notice where appropriate, such as by email or through the Service.

Your continued use of the Service after an updated Privacy Policy becomes effective means you acknowledge and accept the updated policy.
